First Degree Rape Appeal Victory

This week we received an unpublished opinion in one of our appeals.

The result?

The jury’s guilty verdict entered against our client was reversed and the case was remanded to the lower court for a new trial.

The Oklahoma Court of Criminal Appeals agreed that our client was denied his 6th Amendment right to counsel of his choice. Our client had informed the trial court that, after nearly two years of fighting the Rape allegations with retained counsel, he wanted to represent himself at his jury trial. The judge did not think that was a good idea, but he failed to realize that a criminal defendant has a constitutional right to represent himself pro se.

Our client was instead forced to trial with counsel whom he did not want, and was subsequently convicted and sentenced to thirty-five (35) years incarceration. However, with the victory on appeal, our client now has a chance to prove his innocence at a new jury trial.
