Bill Cosby Mistrial: Discussing the Defense Strategy

Many were surprised that the highly publicized jury trial regarding the sexual assault allegations against Bill Cosby ended in a mistrial. However, sex crimes trials often end this way due to the strategies usually employed by the defense team.

There was a huge contrast between the amount of evidence put on by the prosecution and the amount used in the defense case. Pundits from all over the nation have argued, and will continue to argue, as to the merits of a "less is more" approach.

However, as a criminal defense attorney, I can tell you first-hand that the strategy used by Bill Cosby's defense lawyers is one that we use in the majority of sex crimes cases. The defense does not carry the burden of proof, so why would the defense set out to prove anything at all?

In most sexual assault jury trials, the focus will be the reasonable doubts that the defense can establish based on the prosecution's evidence or lack thereof. This is most often accomplished through cross examination and impeachment of the prosecution's witnesses.
