Wanted Sex Offender Caught in Oklahoma

A fugitive on the Texas 10 Most Wanted Sex Offenders list was apprehended in Oklahoma last week after four days on the run from authorities.

Texas Department of Public Safety officials say that Robert Charles Grunsfeld, 51, of Dallas, was taken into custody by Pittsburg County Sheriff's Deputies at a McAlester Taco Bell. According to Pittsburg County Sheriff Joel Kerns, Grunsfeld came to McAlester to get a ride from another sex offender, but instead of giving him a ride, the other person notified his probation officer. 

The Texas Department of Public Safety offered a $3,000 reward for Grunsfeld's capture.

Grunsfeld was placed on the Most Wanted list after he deliberately removed a GPS ankle monitor in violation of his parole, and left a halfway house where he was ordered to live while participating in a civil commitment program. 

According to the Dallas News, Grunsfeld is a serial rapist who used a stun gun, handcuffs, and tear gas spray to incapacitate his victims before raping them. He is considered to be a sexual predator at high risk of reoffending.

Grunsfeld's criminal history dates back to the early 1980's, and he has convictions for six counts of sexual assault, including aggravated sexual assault; three counts of carrying a prohibited weapon; burglary; and fraud. He was sentenced to 20 years in prison for violent and predatory sex offenses, with his prison term ending in 2010. When he was paroled, he was ordered to live in The Way Back House in Dallas, one of nine Texas halfway houses for paroled felons. He remained at the halfway house until November 22, when he cut off his ankle monitor and escaped.

In 1989, two women testified that Grunsfeld raped them while he was free on bail for an earlier rape charge. He is accused of raping a woman on a date in November 1988, raping a topless dancer in May 1989, raping a girl he met at a nightclub in June 1989, and attempting to rape an acquaintance after breaking into her home in September 1989. In the September incident, the woman recognized her attacker, despite the fact he was wearing a ski mask. She testified in October 1989 that he broke into her home wearing a ski mask and gloves and forced her onto the bed. She said she asked, "Robert is that you?" and the assailant "just froze, took off his mask and said, 'Yes, can’t you take a joke?'”

Psychologists testified that Grunsfeld's pattern of attack was becoming increasingly violent, and that his inability to refrain from attacking women--even while on bail for similar crimes--showed that he was a high-risk predator.

Oklahoma's sex offender level assessments are offense-based, meaning that the risk level is assigned purely by the offense for which one was committed, not taking into account any circumstances or details of the specific case or the defendant's behaviors. For this reason, a person convicted of statutory rape--say a 19-year-old having "consensual" sex with a 15-year-old--is placed in the same risk level as a violent serial rapist such as Grunsfeld.
